S63 Action Plan Flowchart
The building to be sold or leased is in excess of 1,000 sq m, based on the Gross Internal Area (GIA).
No Yes
An EPC is produced and lodged.
In Scotland there are no minimum EPC ratings for buildings below 1,000 sq m GIA.
An EPC is produced and lodged on the central database. The EPC advises whether the building meets the 2002 standard.
Based on the EPC, does the building meet the equivalent of the 2002 regulations? See Page 3 of the EPC.
Or does an exemption apply?
  • A building warrant dated on/after 4 March 2002.
  • Improvements through a Green Deal. (Unlikely)
  • Exempt lease types.
No Yes
The EPC advises no further action is required.
An Action Plan is required at this time.
The assessor prepares a Prescriptive, an Alternative Action Plan, and a explanatory report. The Action Plan calculates a target improvement for energy and carbon emission savings within 3½ years.
Prescriptive Plan Alternative Plan
The owner may elect to follow the Reporting Route by lodging annual DECs, or implement the improvement measures from the Action Plan within the timescale.
Reporting Route
Lodge a DEC annually until measures are implemented.
Improvement Route
Implement improvement measures within 3½ years.
A new EPC and Action Plan must be created after works are completed. Once complete, the building may be considered Section 63 compliant.
